Female Workers Migration and Mistreatment in Malaysia: A Case of Housemaids from Central Java

This paper aims to examine the responsibility of the Balai Pelayanan Penempatan dan Perlindungan Tenaga Kerja Indonesia (BP3TKI) as an agency sending female workers from central Java abroad, to identify the main reason why some Indonesian housemaids are badly treated in Malaysia and to highlight the steps taken by the Indonesian and Malaysian governments to cope with this situation. The study uses a phenomenology qualitative approach with a social paradigm definition of micro analysis. The results from this study demonstrate that the main reasons why the Indonesian housemaids are abused are miscommunication, low competency, cultural difference, feudalism behavior, bad institutional structure and difference in Act. Further, the finding shows that the responsibilities of the BP3TKI cover both legitimate and non-legitimate aspects. The steps taken by the Indonesian government include providing assurance to non-problematic employers for employing the Indonesian workers, establishing a Cooperation Agency for problem solving, suggesting a one-day or one-week off to the maids or give them compensation, resolving all problems by the Indonesian and Malaysian Cooperation Associations, and revising the Memorandum of Understanding (MoU) of the Labour Force. Further, the study finds that the model of cooperation for sending housemaids into Malaysia is revising containing among others, higher wage, days off, workers' right to hold their passports, establishment of task force, amendment of Labour Force Act, equal-working appointment, priority for human values and anti-slavery, discrimination, gender and anti-human trade.
